At that time of collision you were behind significantly, but yet, the passing move wasn't complete.
For what I know you could plant that car in the middle of the road and you would not have any obligation to abandon your racing line.
He was too impatient to get back on fast racing line and that resulting in contact, happens.
Check out Redbulls' controversy in Turkey 2010, there's similar case, passing driver forcing a move on passed one, ending in tears...
